Distance Sales Agreement

1. Parties

This Distance Sales Agreement ("Agreement") is entered into between the following parties:

Buyer:
The individual or entity placing an order through the website. The Buyer's identity and contact information are recorded at the time of order placement.

2. Subject of the Agreement

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of products ordered by the Buyer through the Seller's website (ironk9gear.com), in accordance with the provisions of the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Sales Contracts.

3. Product Information

  • •Product details, specifications, and prices are listed on the website.
  • •All products are custom-made to order based on the Buyer's selections.
  • •Product images are for illustrative purposes. Slight variations in color may occur due to screen settings and the handmade nature of the products.
  • •All prices include applicable taxes unless otherwise stated.

4. Payment Terms

  • •Payment is made at the time of order via credit/debit card through iyzico secure payment infrastructure, or by bank transfer.
  • •The Buyer confirms the order upon completing payment. No credit card information is stored on our servers.
  • •Orders are not processed until payment is confirmed.

5. Delivery

  • •Products are delivered to the address specified by the Buyer during order placement.
  • •Since all products are custom-made, production time varies. Estimated delivery time will be communicated upon order confirmation.
  • •The maximum delivery period shall not exceed 30 (thirty) days from the date of order, unless otherwise agreed.
  • •Shipping costs, if applicable, are communicated to the Buyer before order confirmation.
  • •The Seller is not liable for delays caused by force majeure, customs procedures, or the shipping carrier.

6. Right of Withdrawal

In accordance with Article 15 of Law No. 6502, the Buyer has the right to withdraw from the agreement within 14 (fourteen) days of receiving the product, without providing any reason.

Exceptions to the Right of Withdrawal:

  • •Products prepared in accordance with the Buyer's personal requests or needs (custom-made products) are excluded from the right of withdrawal per Article 15(ç) of Law No. 6502.
  • •As IROX K9 Gear products are custom-made to order, the right of withdrawal does not apply.

Manufacturing Defects: If a product has a manufacturing defect, the Buyer must notify the Seller within 7 days with photographs. The Seller will evaluate and resolve the issue at no additional cost.

7. General Provisions

  • •By placing an order, the Buyer accepts all terms of this Agreement.
  • •This Agreement is governed by Turkish law.
  • •In case of disputes, the Consumer Arbitration Committees and Consumer Courts of the Buyer's or Seller's domicile shall have jurisdiction.
  • •This Agreement takes effect upon order confirmation and remains in force until all obligations are fulfilled.

Alıcı:
Web sitesi üzerinden sipariş veren gerçek veya tüzel kişi. Alıcının kimlik ve iletişim bilgileri sipariş sırasında kaydedilmektedir.

2. Sözleşmenin Konusu

İşbu Sözleşme'nin konusu, Alıcı'nın Satıcı'ya ait internet sitesi (ironk9gear.com) üzerinden sipariş ettiği ürünlerin satışı ve teslimine ilişkin tarafların hak ve yükümlülüklerinin 6502 Sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri çerçevesinde belirlenmesidir.

3. Ürün Bilgileri

  • •Ürün detayları, özellikleri ve fiyatları web sitesinde belirtilmektedir.
  • •Tüm ürünler Alıcı'nın seçimlerine göre sipariş üzerine özel olarak üretilmektedir.
  • •Ürün görselleri temsili niteliktedir. Ekran ayarları ve ürünlerin el yapımı olması nedeniyle renklerde küçük farklılıklar olabilir.
  • •Aksi belirtilmedikçe tüm fiyatlar vergiler dahildir.

4. Ödeme Koşulları

  • •Ödeme, sipariş sırasında iyzico güvenli ödeme altyapısı üzerinden kredi/banka kartı ile veya banka havalesi ile yapılmaktadır.
  • •Alıcı, ödemeyi tamamlayarak siparişi onaylamış olur. Kredi kartı bilgileri sunucularımızda saklanmamaktadır.
  • •Ödeme onaylanmadan siparişler işleme alınmaz.

5. Teslimat

  • •Ürünler, sipariş sırasında Alıcı tarafından belirtilen adrese teslim edilir.
  • •Tüm ürünler sipariş üzerine üretildiğinden, üretim süresi değişkenlik gösterir. Tahmini teslimat süresi sipariş onayı sırasında bildirilir.
  • •Aksine bir anlaşma yoksa, azami teslimat süresi sipariş tarihinden itibaren 30 (otuz) günü geçemez.
  • •Varsa kargo ücreti, sipariş onayından önce Alıcı'ya bildirilir.
  • •Satıcı, mücbir sebepler, gümrük işlemleri veya kargo firmasından kaynaklanan gecikmelerden sorumlu değildir.

6. Cayma Hakkı

6502 Sayılı Kanun'un 15. maddesi gereğince, Alıcı ürünü teslim aldığı tarihten itibaren 14 (on dört) gün içinde herhangi bir gerekçe göstermeksizin sözleşmeden cayma hakkına sahiptir.

Cayma Hakkının İstisnaları:

  • •6502 Sayılı Kanun'un 15. maddesi (ç) bendi gereğince, Alıcı'nın kişisel talepleri veya ihtiyaçları doğrultusunda hazırlanan ürünler (kişiye özel üretim ürünler) cayma hakkı kapsamı dışındadır.
  • •IROX K9 Gear ürünleri sipariş üzerine kişiye özel üretildiğinden, cayma hakkı uygulanmaz.

Üretim Hatası: Ürünlerde üretim hatası tespit edilmesi halinde, Alıcı 7 gün içinde fotoğraflarla birlikte Satıcı'yı bilgilendirmelidir. Satıcı sorunu herhangi bir ek ücret olmaksızın değerlendirecek ve çözecektir.

7. Genel Hükümler

  • •Alıcı, sipariş vererek işbu Sözleşme'nin tüm şartlarını kabul etmiş olur.
  • •Bu Sözleşme Türk hukukuna tabidir.
  • •Uyuşmazlık halinde, Alıcı'nın veya Satıcı'nın yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.
  • •İşbu Sözleşme, sipariş onayıyla yürürlüğe girer ve tüm yükümlülükler yerine getirilene kadar geçerliliğini sürdürür.
